From the mouth of an arrogant ignoramus

Liberal Party presidential candidate Sen. Benigno “Noynoy” Aquino appears to be drunk with power that is not even his to exercise and not even if he ever makes it to the Palace.

In a statement Aquino released to the media, he said that not only will he not recognize a Supreme Court Chief Justice (CJ) appointed by Gloria Arroyo if elected president, but that he also warned that any SC associate justice appointed by Gloria “risks his status as a member of the high court.”

“If elected president, I will not recognize a chief justice appointed by the outgoing president, contrary to the constitutional ban on appointments during the wee hours of her presidency, and contrary to propriety, delicadeza and precedence.

“Let me forewarn any member of the Supreme Court who shall accept to be chief justice by appointment of the outgoing president, that not only shall he not be recognized, but he risks even his presence in the court as an associate member.”

The arrogance of it all is appalling, coming from one who is not even president and an ignoramus at that.But in his arrogance, Aquino does show his stupidity in such matters — including his cluelessness of what he can, or can’t do, even if he does get to sit in MalacaƱang.

Whether Gloria can or cannot appoint a CJ upon the retirement of SC CJ Reynato Puno is still to be debated — and in the high court, but only if she appoints a CJ before a vacancy in the CJ seat occurs. To question this in court even if she does appoint a new CJ would be premature, as there is no cause of action as yet.

But for Aquino to state that he will not recognize a Gloria appointed chief justice and even, with hubris and his dictatorial tendencies already showing, warning that any associate justice who accepts the high post coming from Gloria would be fired by him, as he said that justice would be risking his status as a member of the high court, the public has now seen him for what he is: Ignorant, arrogant and dismissive of the Constitution; his usurpation of power as a chief executive even before he wins the post, as well as a glaring gimpse of his dictatorial tendencies.

The fact is that no chief executive, whether Gloria or any other president, can, under the 1987 Constitution, fire any member of the high court. They all have tenures and the only way they can be kicked out of the high bench, is through an impeachment conviction.

Who is Noynoy Aquino, even if he makes it to the presidency, to fire any associate justice who is named CJ?

Those powers are not within the province of a president. He can’t fire the SC justices as his mother, Cory Aquino, did. And to stress, Cory also appointed all the SC justices who in the early years also favored her. Or does he think that having the genes of his parents, he can also fire these SC justices?

But then again, having the same genes as his parents, he probably figures he can also discard the Constitution twice and even abolish Congress, as his mother did.

And who is Noynoy Aquino, even if he does get elected president, not to recognize a new CJ before he takes office, simply because the new CJ was an appointee of Gloria Arroyo, the outgoing president?

What does he mean by saying he will not be recognizing a CJ appointed by Gloria? He is not to respect any ruling made by a high court — a co-equal branch, with the CJ Aquino has not appointed? That is hubris, and ironically from such an ignoramus, and so early in the election game.

Aquino said that in a situation, the act of Gloria in appointing a CJ before she leaves MalacaƱang is “clearly illegal and unconstitutional and without legal effect.”

The illegality or unconstitutionality of an act — even that of an outgoing president — is not for Aquino to decide. It is the high court that will decide this issue, if it chooses to do so, or does Aquino not even know this yet? And he wants to be president? Lord, save our country!

Aquino said Gloria is attempting to usurp the prerogatives vested in the next administration.

And what does he think he is doing by threatening to fire any SC justice that accepts the appointment of CJ by Gloria? That’s even worse. He is, even as he has no mandate and no power at this time, and maybe never, is already attempting to usurp power that not even he or any president has, to fire any SC justice.

But his arrogant and ignorant position is not surprising. The Yellows have always picked and supported a political lemon — all three of them.
