Palace: Not one appointment was made after electoral ban

SUPREME Court administrator and spokesman Jose Midas Marquez yesterday said MalacaƱang may not use the tribunal’s recent decision in appointing officials in other departments of government to various posts.

The high court’s March 17 decision allowed President Arroyo to appoint the successor of Chief Justice Reynato Puno who is retiring in May, saying the election ban on appointments does not cover the judiciary.
 
The election ban started March 10 and will last up to June 30, the end of Arroyo’s term.
"
The SC decision as concurred in by nine justices, and which is not yet final, only exempts appointments to the SC from the ban," he said. The ruling is still subject to review via a motion for reconsideration by the parties.

Marquez issued the statements following reports on the "midnight appointment" of 87-year-old businessman Alfonso Yuchengco as ambassador to Germany, replacing Delia Domingo-Albert.

Albert was reportedly informed of her relief on March 19, the day she received from President Arroyo the Most Outstanding Filipino Woman in Global Diplomacy award in MalacaƱang.

The reports quoted an official of the Department of Foreign Affairs as saying officials are usually given a 60-day recall notice.

Press Secretary Crispulo Icban said Albert is no longer a career official because she retired in 2005, and her appointment had been extended annually since 2005, recallable at any time.

Gary Olivar, deputy presidential spokesman, said all appointments are legal.

He said the media’s lumping of the reports on President Arroyo’s new appointees made them look like midnight appointments.

"All of these appointments were actually made over an extended period of time. Kaya lang ang appearance ay sabay-sabay dahil sa pagkaka-report kaya ang akala ng mga tao na parang minamadali ni Pangulo," Olivar said.

Olivar said most of the appointment papers were signed before the March 10 deadline.

He said some of the appointments were temporary, such as the acting department heads, to maintain continuity of service while some were just transfers.

He said the appointment of Energy Undersecretary Jose Ibazeta as officer in charge of the Department of Energy was meant to fill the vacancy created by the resignation of Energy Secretary Angelo Reyes, who is running for a party list seat.

He asked the opposition to stop injecting politics in the President’s appointments and using them to score points in their campaign.

Aside from Yuchengco, among other appointees announced last week by the Palace were Cynthia Carreon as head of the Tourism Promotions Board; Mark Lapid as chief operating officer of the Tourism Infrastructure and Enterprise Zone Authority, and Alfonso Cusi, general manager of the Manila International Airport Authority as head of the Civil Aviation Authority of the Philippines. – Evangeline de Vera and Regina Bengco
